PLEASE READ CAREFULLY. THIS IS A RELEASE OF LIABILITY & WAIVER OF CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION. EACH PERSON PARTICIPATING IN ACTIVITIES (DEFINED BELOW) IS REFERRED TO AS A “BUYER”, “I”, OR “ME”. I, THE UNDERSIGNED, AM A BUYER AND, IF A BUYER IS A MINOR/INFANT, I AM THE BUYER’S PARENT OR LEGAL GUARDIAN.

FACILITY RULES. By purchasing a ticket and entering Pumpkin Party (the “Facility”) and participating in features and/or activities at the Facility, including ball pits, pumpkin pillow, slides, riding the train, races, participating in recreational activities, using parking lots, walkways, booths, restaurants, and other equipment, for any purpose (collectively “Activities”), the Buyer(s) agrees to observe all Facility rules listed below. I further acknowledge that the failure to observe all Facility rules may result in injury to Buyer(s) or Buyer(s) being asked to leave the Facility without a refund.

I AM AWARE AND UNDERSTAND THAT THE ACTIVITIES ARE POTENTIALLY DANGEROUS AND INVOLVE THE RISK OF SERIOUS INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE. I ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY RESULT FROM OR BE COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF THE RELEASEES (DEFINED BELOW), INCLUDING NEGLIGENT EMERGENCY RESPONSE OR RESCUE OPERATIONS. NOTWITHSTANDING THE RISK, I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN THE ACTIVITIES, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF THE RELEASEES OR OTHERWISE.


In consideration of being permitted to participate in the Pumpkin Party, including activities such as trampoline pads, ball pits, races, train riding, slides, wagons, booths, and more, organized by Wonder Entertainment, hereinafter referred to as "the Organizer," I, the undersigned participant (or parent/guardian of a minor participant), do hereby acknowledge and agree to the following terms and conditions:

**1. Assumption of Risk:** I understand that participating in the Pumpkin Party activities involves inherent risks, including, but not limited to, the risk of injury from falls, collisions, equipment use, and other unforeseen circumstances. I acknowledge that these risks are part of the activity, and I voluntarily assume all such risks on behalf of myself (or my child).

**2. Release of Liability:** I hereby release, discharge, and hold harmless the Organizer, its officers, directors, employees, agents, volunteers, and all other participants from any and all claims, liabilities, demands, actions, or causes of action, whether in law or equity, arising out of any injury, loss, damage, or other harm that may occur as a result of my (or my child's) participation in the Pumpkin Party activities.

**3. Indemnification:** I agree to indemnify and hold the Organizer and its representatives harmless from any loss, liability, damage, or costs, including attorney's fees, that they may incur as a result of any injury, loss, damage, or harm caused by me (or my child) during participation in the Pumpkin Party activities.

**4. Medical Treatment Authorization:** In the event of an injury or medical emergency, I authorize the Organizer to obtain and administer any necessary medical treatment for me (or my child). I also agree to be financially responsible for any medical expenses incurred as a result of such treatment.

**5. Photographic and Video Consent:** I grant the Organizer and its representatives the right to take photographs and videos of me (or my child) during the Pumpkin Party for promotional and marketing purposes without compensation. I understand that these images may be used in various media, including print, online, and social media.

**6. Compliance with Rules and Instructions:** I agree to comply with all rules, instructions, and guidelines provided by the Organizer for the Pumpkin Party activities and to act in a safe and responsible manner.

**7. Governing Law:** This waiver and all matters arising out of or relating to it shall be governed by and construed in accordance with the laws of the state/province of Utah, without regard to its conflict of laws principles.
